Terms of Service
The agreement between you and TruckerEchelon for using our platform. Plain language up top, full legal language below. You must be 18 and hold a valid CDL to use driver features.
01Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and TruckerEchelon ("Company," "we," "us," or "our") governing your use of the TruckerEchelon mobile application and related services (collectively, the "Service").
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.
02Description of Service
TruckerEchelon provides tools for commercial truck drivers and motor carriers, including:
- Route planning and optimization
- Real-time fuel price comparison
- Weather and road condition information
- Hours of Service (HOS) tracking assistance
- IFTA mileage tracking and reporting
- Trip management and documentation
- Fleet management tools (Company accounts)
03Account Registration
3.1 Account creation
To use certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and update your information as needed
- Keep your password secure and confidential
- Accept responsibility for all activity under your account
- Notify us immediately of any unauthorized access
3.2 Identity verification
We may require identity verification (KYC) for certain features, including community features. Verification is performed by ComplyCube, a third-party provider. By using these features, you consent to this verification process.
3.3 Account termination
You may delete your account at any time through the app settings. We may suspend or terminate your account if you:
- Violate these Terms
- Provide false information
- Engage in fraudulent or illegal activity
- Abuse other users or our staff
04Subscriptions and Payments
4.1 Subscription plans
We offer Free, Pro ($19.99/month), and Company ($69.99/month) subscription tiers. Features and pricing are subject to change with notice.
4.2 Billing
- Subscriptions are billed monthly in advance
- Payment is processed through Apple App Store or Google Play
- Subscriptions auto-renew unless canceled at least 24 hours before the renewal date
- Prices are in USD and may vary by region
4.3 Refunds
Refunds are handled according to Apple App Store and Google Play policies. We do not directly process refunds for in-app purchases. Contact the respective app store for refund requests.
4.4 Price changes
We may change subscription prices with 30 days' notice. Price changes take effect at the start of your next billing cycle after the notice period.
05Acceptable Use
You agree not to use the Service to:
- Violate any laws, regulations, or third-party rights
- Submit false, misleading, or fraudulent information
- Impersonate any person or entity
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to any part of the Service
- Use automated systems (bots, scrapers) without permission
- Reverse engineer, decompile, or disassemble the Service
- Harass, threaten, or abuse other users
- Post illegal, offensive, or harmful content
- Use the Service for any commercial purpose not expressly permitted
06Intellectual Property
6.1 Our property
The Service, including all content, features, and functionality (software, text, graphics, logos, and design), is owned by TruckerEchelon and protected by copyright, trademark, and other intellectual property laws.
6.2 Limited license
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business purposes in accordance with these Terms.
6.3 Your content
You retain ownership of content you submit (trip notes, photos, etc.). By submitting content, you grant us a non-exclusive, royalty-free license to use, store, and process that content to provide the Service.
6.4 Feedback
If you provide feedback, suggestions, or ideas, you grant us the right to use them without compensation or attribution.
07Third-Party Services
The Service integrates with third-party providers including:
- Mapbox: Mapping and routing (subject to Mapbox Terms)
- OpenWeatherMap: Weather information
- NOAA: Weather data and forecasts
- FMCSA: Carrier safety data
- ComplyCube: Identity verification
- Stripe: Payment processing
Your use of third-party services is subject to their respective terms and privacy policies. We are not responsible for third-party services.
08Disclaimers
8.1 No warranties
8.2 Accuracy of information
While we strive for accuracy, we do not guarantee that:
- Route calculations are optimal or error-free
- Fuel prices are current or accurate
- Weather data reflects real-time conditions
- Compliance information constitutes legal advice
- The Service will be uninterrupted or error-free
8.3 Professional responsibility
You are solely responsible for:
- Safe operation of your vehicle
- Compliance with all applicable laws and regulations
- Maintaining valid ELD records (this app is not an ELD)
- Verifying information before relying on it
- All business and driving decisions
09Limitation of Liability
- Loss of profits, revenue, or data
- Business interruption
- Vehicle accidents or damage
- Regulatory fines or penalties
- Personal injury (except where prohibited by law)
10Indemnification
You agree to indemnify, defend, and hold harmless TruckerEchelon and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of any applicable laws
- Content you submit to the Service
11Dispute Resolution
11.1 Governing law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. TruckerEchelon is a Delaware corporation with operations in Texas.
11.2 Informal resolution
Before filing any formal dispute, you agree to contact us at support@truckerechelon.com and attempt to resolve the dispute informally for at least 30 days.
11.3 Arbitration agreement
Any dispute not resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. Arbitration will be conducted in Texas or via video conference at your option.

Either party may seek injunctive relief in court for intellectual property infringement or other urgent matters.
12General Provisions
12.1 Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 30 days before taking effect. Continued use after changes constitutes acceptance.
12.2 Entire agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and TruckerEchelon regarding the Service.
12.3 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
12.4 Waiver
Our failure to enforce any provision does not waive our right to enforce it later.
12.5 Assignment
You may not assign your rights under these Terms. We may assign our rights to any affiliate or successor.
12.6 Force majeure
We are not liable for delays or failures caused by events beyond our reasonable control (natural disasters, war, government actions, etc.).
